1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and VATSAL SANJAY KANAKIYA ("Couple Snaps", "we", "us", or "our") governing your access to and use of the Couple Snaps website and AI-powered couple photo generation service (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account by signing in with Google OAuth. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

3.2 Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we deem inappropriate or harmful to the Service or other users.

4. Service Description

Couple Snaps provides an AI-powered service that allows users to:

• Upload two separate photos of individuals
• Generate AI-created couple photos with various poses, backgrounds, and styles
• Download generated images (watermarked for free tier)
• Access premium features (if subscribed)

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the Service for lawful personal or commercial purposes, including:

• Creating couple photos for personal use
• Generating images for social media
• Creating romantic gifts or keepsakes

5.2 Prohibited Uses

You agree NOT to use the Service to:

• Upload photos of minors (under 18 years old) or use the Service for content involving children
• Generate explicit, pornographic, or sexually suggestive content
• Create deepfakes, misleading content, or non-consensual imagery
• Upload photos of individuals without their explicit consent
• Generate content that is illegal, defamatory, harassing, or violates third-party rights
• Impersonate any person or entity, or falsely represent affiliation with any person or entity
• Reverse-engineer, decompile, or attempt to extract the AI models or source code
• Use automated tools, bots, or scripts to access the Service without authorization
• Interfere with or disrupt the Service or servers
• Violate any applicable laws or regulations

Violation of these prohibitions may result in immediate account termination and potential legal action.

6. Content Ownership and Licenses

6.1 Uploaded Photos

You retain all ownership rights to photos you upload. By uploading photos, you grant us a limited, non-exclusive, worldwide license to process, store, and use your uploaded photos solely for the purpose of generating AI images. Uploaded photos are deleted immediately after generation is complete.

6.2 Generated Images

Free Tier: Generated images include a watermark. You may use watermarked images for personal, non-commercial purposes.

Premium Tier: You receive unwatermarked images and full commercial usage rights to the generated content.

You acknowledge that AI-generated images are created using machine learning models and may not be entirely unique. We do not guarantee exclusive rights to generated content.

6.3 Service Content

All content on the Service, including but not limited to text, graphics, logos, software, and AI models, is the property of Couple Snaps and is protected by copyright, trademark, and other intellectual property laws.

7. Payment and Billing (Premium Features)

7.1 Pricing

Couple Snaps offers both free and premium tiers. Premium pricing is displayed on our website and may be changed at any time. We will provide notice of price changes for existing subscribers.

7.2 Billing

Premium subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method on each billing cycle.

7.3 Refund Policy

Due to the nature of AI-generated content (immediate delivery upon generation), we generally do not offer refunds. However, if you experience technical issues or service failures, please contact support@couplesnaps.com within 7 days, and we will evaluate refund requests on a case-by-case basis.

7.4 Cancellation

You may cancel your premium subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 AI Generation Quality

We do not guarantee the quality, accuracy, or suitability of AI-generated images. Generated content may contain artifacts, inconsistencies, or unexpected results due to the nature of AI technology.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COUPLE SNAPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ₹1,000 (ONE THOUSAND INDIAN RUPEES), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Couple Snaps, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or generate using the Service

11. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the Service after revisions become effective, you agree to be bound by the updated Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Couple Snaps regarding the Service.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
